Have you ever bought a car or been gifted one by a friend? Did you know that a motor vehicle registration book (Log Book) is the one which proves ownership of the vehicle? Is the log book of the vehicle registered in your names?
Well if you are looking for answers to such questions then this brief write up will sort you out.
There are two scenarios where transfer of ownership of a motor vehicle can be done namely;
1. When the transferor (current owner) is present and willing to sign the transfer form
2. Where the transferor is absent or unwilling to sign the transfer form.
1. When the transferor (current owner) is present and willing to sign the transfer form.
i. The current owner has to log into his created account on the URA website and go to the vehicle transfer page.
ii. He or she will be prompted to enter the details to whom the vehicle is transferred to for example the TIN number of the owner to be.
iii. The owner to be will have to log in to his URA account as well on site and accept the transfer of which the process will be sent to one of the URA staff to oversee.
iv. Upon successful verification of both the transferor and the transferee details, the new owner will be issued a new log book of the vehicle.
v. The process will end and the log Book will now be in the names of the new owner.
2. Where the transferor is absent or unwilling to sign the transfer form
i. Applicant swears an affidavit and a notice is issued in a newspaper of wide circulation declaring an intention to transfer the motor vehicle and calling upon the registered owner to declare their objection if any to the High Court within 2 weeks.
ii. Apply to court and obtain an Order Compelling URA to effect the transfer by notice of motion supported by an affidavit
iii. Assessment and payment of fees
iv. Present a certified copy of the order and all necessary attachments to URA.
v. Avail the vehicle to the licensing authority officer for inspection.
v. Having completed all the above the licensing officer will then process and issue a new registration book in the names of the current owner.
